Information we Collect and How We Use It:
We offer a number of services that do not require you to register for an account or provide any personal information to us, such as viewing Music Xray and browsing our site information. In order to provide our full range of services, we may collect the following types of information:
Information you provide
7 Benefit to you of providing personal information - The personal information you provide helps Music Xray provide better services to users, including the display of customized content and advertising; helps us audit and analyze our products so we can maintain, protect and improve our services; helps us develop new services and ensure that the technical functioning of our network.
Music Xray processes personal information on our servers in the United States of America. In some cases, we may process personal information on behalf of and according to the instructions of a third party, such as our advertising partners.

When you sign up for a particular service that requires registration, we ask you to provide personal information. If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.
Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Music Xray features and services may not function properly if your cookies are disabled.
You can decline to submit personal information to any of our services, in which case Music Xray may not be able to provide those services to you.
Music Xray only shares personal information with other companies or individuals outside of Music Xray in the following limited circumstances:
1 We have your consent. We require opt-in consent for the sharing of any sensitive personal information.
3 We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Music Xray, its users or the public as required or permitted by law.
We may share with third parties certain pieces of aggregated, non-personal information, such as the number of users who searched for a particular song, for example, or how many users clicked on a particular advertisement. Such information does not identify you individually.

Security Measures -
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.
We restrict access to personal information to Music Xray employees, contractors and agents who need to know that information in order to operate, develop
or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal
prosecution, if they fail to meet these obligations.
When you use Music Xray services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.
When we receive formal written complaints at this address, it is Music Xray's policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between Music Xray and an individual.

We obtain personal information only as permitted by the Safe Harbor Principles or with the consent of the individual affected. We may ask for your consent to collect, use, or disclose personal information in certain ways, and you may be required to give your consent in order to use our services. To the extent permitted under the Safe Harbor Principles, we reserve the right to process personal information in the course of providing services through the Services without the knowledge of individuals involved. If you wish to opt out of our collection or our disclosure of personally identifiable information to third parties, you may contact us at the address noted in our CONTACT US section with a request to do so. The request should include your name, email address, login information, and any specifics that may help us to prevent the collection of personally identifiable information you do not wish to have collected or disclosed. Please note that if you opt out of our data collection practices, the Services may be less functional for you.
Security & Enforcement
Opting Out of Information Sharing
We understand and respect that not all customers may want to allow us to share their information with other select companies. If you do not want us to share your information, please contact us through the Contact Us page of any of our brands, and we will remove your name from lists we share with other companies as soon as reasonably practicable. When contacting us, please clearly state your request, including your name, mailing address, email address and phone number.
However, under the following circumstances, we may still be required to share your personal information:
• If we respond to subpoenas, court orders or legal process, or if we need to establish or exercise our legal rights or defend against legal claims.
• If we believe it is necessary to restrict or inhibit any user from using any of our Sites and Apps, including, without limitation, by means of "hacking" or defacing any portion thereof.
California's "Do Not Track" Notice . "Do Not Track" ("DNT") is a preference you can set in your web browser to let the sites you visit know that you do not want them collecting information about you. We do not knowingly collect or distribute personally identifiable information from children under the age of 13. If you are the parent or guardian of a child under the age of 13 and believe that we have collected personally identifiable information contrary to this policy or, in the United States, the Children’s Online Privacy Protection Act (COPPA), please contact us by e-mail so that we may delete such information. Access to your Account Information and Preferences
You have the right and ability to edit your member account information on our Sites and Apps at any time. You can opt in or out of receiving future communications from us about special offers and new product information, you can unsubscribe by following instructions contained in the messages you receive, or you can change your marketing preferences by contacting us through the Contact Us page of any of our brands. We do reserve the right to send you certain communications relating to the services we provide, such as service announcements and administrative messages. We do not offer you the opportunity to opt-out of receiving those communications.
Your California Privacy Rights
California Civil Code Section 1798.83, also known as S.B. 27, allows individual customers who have provided their personal information to us to request information about our disclosure of certain categories of personal information to third parties for their direct marketing purposes. Such requests must be submitted to us through the various ways of contact described in the Contact Us page of any of our brands. Within thirty days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for third party direct marketing purposes during the immediately preceding year, along with the names and addresses of those third parties. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted in ways other than those specified above.
Class Action Waiver
ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL LEGAL ACTION. YOUR ACCESS AND CONTINUED USE OF ANY OF OUR SITES AND APPS SIGNIFIES YOUR EXPLICIT CONSENT TO THIS WAIVER.
